Booking Terms and Conditions


  1. ‘Customer’ means the person who buys or agrees to buy the training course from the Seller.
  2. ‘Conditions’ means the terms and conditions of business set out in this document and any special terms and conditions agreed in writing by the Seller.
  3. ‘Course Date’ means the date specified by the Seller (On acceptance of the Customer’s application) when the Course is to be held.
  4. ‘Course’ means the articles, which the training course that the Customer agrees to buy from the Seller.
  5. ‘Price’ means the price for the Course including VAT.
  6. ‘Seller’ means Military Fitness Limited, trading as British Military Fitness

Conditions applicable 

  1. These Conditions shall apply to all contracts for the sale of Courses by the Seller to the Customer to the exclusion of all other terms and conditions including any terms or conditions which the Customer may purport to apply under any purchase order confirmation of order or similar document.
  2. Any application for a Course shall be deemed to be an offer by the Customer to buy the Course pursuant to these Conditions.
  3. Acceptance of the Customer’s application shall be deemed conclusive evidence of the Customer’s acceptance of these Conditions.
  4. Any variation to these Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Seller.

The Price and payment 

  1. The Price shall be the price set out on the application form and is inclusive of VAT. VAT receipts can be issued on request.
  2. Payment of the Price shall be due as provided on this form for the relevant Course. Time for payment shall be of the essence and the Seller reserves the right to terminate this agreement forthwith with no liability attaching to the Seller under such circumstances if the Customer does not adhere strictly to the payment schedule.

The Course

  1. The description of the Course shall be as set out in the Seller’s standard website application form.

Warranties and liability

  1. The Seller warrants that the Course will at the time of delivery correspond to the description given by the Seller. All other warranties, conditions or terms relating to the Course and complying with description and whether implied by statute or common law or otherwise are excluded.

Holding of the Course

  1. The Seller reserves the right to vary the times and venue of each Course (or even to cancel a Course altogether) should it be necessary for reasons outside its reasonable control to do so e.g. unavailability of instructor, venue etc. The Seller is not liable for any loss suffered by the Customer as a result of any such changes and the Seller will refund any deposit and other payment made in full if the Customer is unable to attend the date or venue of a rearranged Course.
  2. The Seller makes no warranty as to availability of travel to or accommodation at the venue for the Course and the Customer accepts full responsibility for ensuring that all required bookings for these are in place before entering into commitment for a Course. The Customer warrants that it has made all such enquiries and reservations before submitting this application form and that the delegate for the Course will be available to travel to and attend the Course.

Non attendance

  1. If you fail to attend the first day of the course without notifying us and do not wish to transfer onto another course you will lose any monies paid and be liable for the full cost of the course.


  1. Should you wish to cancel a course within 28 days of the start date, any initial payments will be non-refundable. Students will be liable for costs of ordered materials incurred.
  2. In special circumstances, we may allow your payments to carry forward to the next available course should you wish to attend that.

Transfer to another course

  1. Level 2 customers looking to transfer to another course within 28 days prior to the course start date will be charged £50 within this time.
  2. Level 3 or Level 4 customers looking to transfer to an alternative course within 28 days prior of the booked course starting may be subject to a £100 administration fee.
  3. Transfers for Level 3 and Level 4 courses within 14 days prior to the course start date will be charged at £200. This may be waived if their forfeited place is purchased on the course.
  4. If a customer requests to transfer to an alternative course during a current course, this may be subject to a £200 administration fee.


  1. If you are not successful then you may re-sit parts of the course as below:
    1. Theory Test re-sit
      1. Within the assessment weekend of the course, you should be able to re-sit the test once for free
      2. If you are referred after the initial re-sit, the re-sit cost of a theory exam is £50 (per exam). The re-sit will be scheduled as part of the next ongoing course, or at the earliest opportunity.
      3. If you are referred after the 3rd attempt, you will have failed the course and will need to attend the full course again.
    2. Practical re-sit
      1. If you are referred on the practical assessment, you can be re-assessed on the next course (subject to space on course), or at earliest availability . This is at a cost of £100 for Level 2. For L3 and L4 courses, it will be based on a case-by-case basis depending on what requirements the learner has failed to meet. This will be capped to £250.
      2. If you fail the second practical assessment (first re-sit), this will be classed as a fail and you will be required to re-sit the full course.
    3. If you fail both the practical and theory elements of the course, it will be at the disgression of the Academy Manager and the Academy Tutor as to whether you should re-sit only the assessments, or would be required to attend another full course (at the customer’s expense).
  2. Re-sits will not be scheduled until full payment has been received, and until the re-assessment has been confirmed by the Academy Manager.

Late Submission of coursework or portfolio

Failure to submit coursework within the required timeline of the course will result in additional fees to cover tutor costs and extra administrative work as a result. This is billed at £50 for the first hour, and £15 per hour of work after.


Official certificates may not be awarded to customers until any outstanding monies are received. This is at the disgression of the Academy Manager.

Exclusion and Limitation of Liability

  1. The Seller is not liable for any loss suffered by the Customer whether by reason of breach of contract, negligence or otherwise for any loss or consequential loss (including loss of profits, damage to reputation or goodwill, loss of business, damages costs or expenses or any other indirect or consequential losses) occasioned to any person acting, omitting to act or refraining from acting in reliance on the Course or, except to the extent that any such loss does not exceed the Price, arising from or connected with any error or omission in the Course or its presentation.

If any negligence on the part of the Company is established, then the maximum liability on the part of the Company will be determined by the maximum indemnity afforded by the Company’s insurers.
